Terms of Service
Please read these Terms of Service ("Terms") carefully before using Matchpools. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use Matchpools.
1. About Matchpools
Matchpools is a community-based dating application operated by Equilibrium LLC. The Service allows users to join and create "Pools" — curated groups built around shared relationship goals, lifestyles, and standards — and to discover potential romantic connections within those Pools. Matchpools is currently available to college students aged 18 and older.
2. Eligibility
To use Matchpools, you must:
Be at least 18 years of age
Be enrolled at or affiliated with a college or university (during the current college-student phase of the app)
Have the legal capacity to enter into a binding agreement
Not be barred from using the Service under applicable law
By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate accounts that do not meet these criteria.
3. Account Registration
To access Matchpools, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain and update your profile to keep it accurate
Keep your login credentials secure and not share them with anyone
Notify us immediately if you become aware of unauthorized access to your account
You are responsible for all activity that occurs under your account. Matchpools is not liable for any loss arising from unauthorized account use.
4. Pools: Creation, Membership, and Conduct
4.1 Joining Pools
You may browse available Pools and request to join any Pool that aligns with your goals, values, or lifestyle. Acceptance is at the Pool creator's discretion. Once inside a Pool, you can view and swipe on other Pool members' profiles.
4.2 Creating Pools
Any eligible user may create a Pool. As a Pool creator, you:
Are responsible for setting an accurate and honest Pool description, theme, and stated criteria
Have discretion to accept or decline join requests from other users
Must not create Pools intended to harass, exclude users based on protected characteristics (such as race, religion, or disability), or violate these Terms
Acknowledge that Matchpools may remove or moderate any Pool that violates our Community Standards
4.3 Matching Within Pools
Swiping and matching occur exclusively within the Pool context. A mutual match occurs when two users within the same Pool both express interest in each other. Matches enable private messaging between matched users.
5. Community Posts
Matchpools includes a community feature that allows users to post anonymously or publicly. By posting, you agree that:
Anonymous posts conceal your identity from other users, but not from Matchpools staff for moderation purposes
Public posts display your name and profile photo to other users of the Service
All posts must comply with our Community Standards outlined in Section 7
You grant Matchpools a limited license to display your posts within the app as part of normal Service operations
6. User Content
6.1 Your Content
You retain ownership of all content you upload or post to Matchpools, including profile photos, bios, messages, and community posts ("Your Content"). By submitting Your Content, you grant Matchpools a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute Your Content solely for the purpose of operating and improving the Service.
6.2 Content Restrictions
You agree not to upload or share content that:
Is false, misleading, or misrepresents your identity, age, or college affiliation•
Contains nudity, explicit sexual material, or graphic violence
Harasses, threatens, or demeans other users
Constitutes spam, unsolicited commercial messages, or phishing
Infringes on any third party's intellectual property rights
Violates any applicable law or regulation
7. Community Standards
Matchpools is built around intentional, respectful dating. All users must:
Represent themselves honestly in their profiles and within Pools
Treat other users with respect in messages, Pool interactions, and community posts
Not use the platform to solicit money, promote unrelated businesses, or engage in any commercial activity
Not attempt to circumvent Pool membership criteria through deception
Report suspected violations using in-app reporting tools
Violations of Community Standards may result in warnings, Pool removal, content removal, account suspension, or permanent ban depending on severity.
8. Prohibited Conduct
In addition to the content restrictions above, you may not:
Reverse engineer, decompile, or attempt to extract source code from the app
Use bots, scripts, or automated tools to interact with the Service
Scrape or collect other users' data without consent
Impersonate another person or entity
Interfere with or disrupt the technical infrastructure of the Service
Create multiple accounts to circumvent bans or Pool rejections
9. Intellectual Property
The Matchpools name, logo, app design, and all original content created by Equilibrium LLC are protected by copyright, trademark, and other applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Matchpools' proprietary content without our express written permission.
10. No Guarantee of Matches or Outcomes
Matchpools provides tools and community infrastructure to help college students connect. We do not guarantee that use of the Service will result in matches, dates, relationships, or any specific romantic outcome. The quality of interactions depends on users and is outside our control.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EQUILIBRIUM LLC DISCLAIMS ALL WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUILIBRIUM LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING DAMAGES RELATED TO MATCHES, DATES, OR INTERACTIONS FACILITATED THROUGH MATCHPOOLS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100 USD.
13. Indemnification
You agree to indemnify and hold harmless Equilibrium LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
14. Termination
Either you or Matchpools may terminate your account at any time. We reserve the right to suspend or terminate your account without notice if we determine you have violated these Terms or our Community Standards. Upon termination, your right to use the Service ends immediately. Sections on intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
15. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration, except that either party may seek emergency injunctive relief in a court of competent jurisdiction. You waive any right to participate in class-action proceedings.
16. Changes to These Terms
We may update these Terms from time to time. We will post any material changes within the app and update the effective date. Your continued use of Matchpools after the revised Terms are posted constitutes your acceptance of the updated Terms.
